These Terms and Conditions / Terms of Service (“Terms” / TOS / Website Terms) read with the privacy policy, disclaimers, rules of the Excitel Broadband Private Limited as may be posted on this Website, having domain name https://www.excitel.com/about-us/, from time to time, shall govern your use / access of the Website, (“Website”), its related content, sites and hyperlinks owned maintained and operated by the Company and or its Affiliates and the domain name is owned by one of its Affiliates. These Terms apply to all Users of the Website.
The Visitor must accept the Terms and Conditions set herein below as a pre-condition for availing the services of the Excitel Broadband Private Limited (hereinafter referred to as (“Company”). These Terms and Conditions shall be binding on the Visitor:
- The Visitor consents to use the internet services provided by the Company only for the legitimate purpose or objectives and not to engage in the operation of any unlawful transaction or business.
- The services offered by the Company are for private and personal use only. All the content viewed through our services is solely for personal, non-commercial use, not for use in the operation of business or service bureau, not for any other public viewing and for profit or for the benefit of any person or entity other than the Authorised User.
- The commencement of the services is subject to technical feasibility of the connection and the realization of the payment. The Company shall not be responsible for any direct, consequential or other loss incurred or suffered by the Visitor due to delay in installation or commencement of services.
- It is the Visitor’s responsibility to maintain the internet connectivity necessary to access the Company’s services.
- The service plans offered by the Company are available on the Website with a price list. The Company reserves its right with any plan, amend, the price or entitlements under the plans without notice.
- Tariff /Charges for the plans chosen are to be paid in advance and such charges are not refundable as this is a prepaid service. The Visitor understands and agrees that the payments made for using the services are non-refundable. The Company is not obligated and the Visitor is not entitled and hereby waives any right to any credit, refund, price adjustment or any other discount, compensation for not being able to access the particular Website or download apps or other incidental matters.
- The services provided by the Company is a prepaid service and will be in force as to the equivalent amount paid in advance, once the Visitor has used the services of the Company to the amount paid in advance, the services will be suspended for a short time till the amount is paid again by the Visitor in advance. Subsequent to which services will be renewed.
- GST @ 18% or amended percentage notified by the Govt from time to time is not included in the tariff/ charges and is payable over and above the plan charges.
- The Tariff Plans/Offers are subject to Guidelines/Directions/Orders issued by TRAI and/or DoT.
- The Company shall reserve the rights to modify/withdraw this T&C including but limited to tariff plans and display the same in its website without notice to the Visitor and such posting will be deemed to have been read by the Visitor.
- Any one time charges paid to Company’s Regional Partners at the time of installation are non-refundable.
- Company may extend refund to User only for his first payment in case of no-feasibility for building new connection to requested address.
- Online refund may be extended to the User, when the transaction is incomplete, in the sense that the User’s plan is not renewed, but online payment has been generated.
- The Visitor will be fully responsible for the proper upkeep, safety of Operational Network Unit (“ONU”) devices till the time the same is in Visitor’s possession. The Visitor will be fully responsible to pay Company repair, maintenance charges if the said device is damaged or tampered with. The Company further reserves its right to retain the security amount if the ONU is not found in the same condition as it was handed to the Visitor.
- The ONU devices provided by the Company against a security deposit will remain a property of the Company at all times and Visitor shall not claim any ownership rights on the same at any given point of time.
- The ONU device provided by the Company has a warranty provided by the Company which may be changed from time to time as we get from the supplier and warranty will apply if the same has not expired. If any defect occurs in the device is not due to the defects covered by the Company, then Visitor will be liable to pay for the same.
- Interest free security deposit to be refunded after return of assets in the same condition at the time of receipt, will be processed within 30 days of acceptance of ONU by the Company.
- ONU to be returned to a “person” appointed by Company. It can be the local cable operator, Company’s retail partner or any logistics company appointed by Company to recover back the ONU from Visitor location.
- Any fault in ONU to be replaced by Company within 5 working days from the time of raising complaint with the Complaint.
- Replacement of ONU due to upgrade / downgrade will be done by the Company within 5 working days from the time of raising request with Company.
- In the event of termination of services for any reason, the Company retains the right to recover any and all devices belonging to the Company and Visitor shall permit the Company’s regional partners or authorized personnel to effect such removal without any hindrance, and without prejudicial to any amounts due from the Visitor to the Company.
- No action, documentation, contracts prepared by the Visitor or utilized by the Visitor for contracting with any parties shall alienate, or seek to alienate, the Company’s right to recover the device in the event of non-renewal or termination.
- Refund to be processed to the bank account provided at the time of registration or to the bank account / wallet linked to the phone number registered with the Company. No other bank account to be used for refunds. Cash and Cheque not to be used for Visitor refund.
- The speed committed under a plan is till the LAN port. WiFi Speed is subject to Visitor premises in-house coverage & Visitor premises device performance.
- The Company shall reserve the rights to modify/withdraw any promotional campaign along with offered gratification (if any) and display the same in its website without notice to the Visitor and such posting will be deemed to have been read by the Visitor.
- Basis for selection of winners under any promotional campaign held by the Company, is on the Company’s sole discretion
- By submitting your information and/or contacting us through any medium like phone call, social networking channels, Website, etc, you agree to receive any promotional messages, material and be contacted by Company or their sub-vendors.
- All mentioned plans are subject to change or discontinuation without prior information.
- Not all offered prices are available on renew and not all are available across the nation.
- The Company will not be responsible for any commitment, representation, offerings made by the Company’s regional partners/dealers without the consent of the or direction of the Company. Visitors who are promised or offered any sought of commitment are advised to cross check the same with the Company. Any loss or damage caused on account of representations or offerings made by the regional partners/dealers of the Company without the consent of the Company, the Company shall not be liable or responsible for damage or loss caused to the Visitor.
- The Company reserves the right to withdraw or terminate its services without notice in the event of:
- Wrongful, malicious or fraudulent representations by the Visitor in respect of the details required by the Company for providing services to the Visitor.
- Use of services by the Visitor for illegal purposes.
- Resale or unauthorized additional connections from the connection supplied hereby to the Visitor.
- Where Visitor uses any kind of abusive or offensive language against the employees of the Company while lodging complaints or in respect of other purposes.
- Where there is any order from Government authorities.
